Consumer Council's Submission to the Subcommittee to Study Six Items of Subsidiary Legislation under the Trade Descriptions Ordinance Gazetted on 18 April 2008

1.        The Council is supportive of the six items of subsidiary legislation under the Trade Descriptions Ordinance gazetted on 18 April 2008. It believes that the imposition of the obligation on retailer to issue invoice or receipt to buyer; and the requirements for prescribed information to be contained in that invoice or receipt, and prescribed notice to be displayed at the point of supply or offer, as provided by the said gazetted legislation, would mitigate the risk of misrepresentation that consumer may encounter in the purchase of the goods concerned.

2.        In addition, the gazetted amendments to the existing marking orders regarding Gold, Gold Alloy and Platinum would remove certain ambiguities over the trade descriptions on the said precious metals, and thus bring benefit to consumers.

3.        As auction is a form of supply of goods to consumer, the Council also welcome the inclusion of sale by auction in the regulation under the gazetted information and amendment Orders.
